Yes this really helps.

 

With the doors open it's effectively outside. It's a small place.

 

If it was Something like 10/10:30 doors close. We could cope with that and would be happy.

 

Part of the stress is the unpredictability of it. 2/3 nights no noise. Then we to bed and suddenly loud music all evening!

 

If the boundaries were clear, then we could manage with noise in the early evening. Knowing that it would be doors closed for when we can sleep. We don't want them to close, or ruin their business - they are nice people.

However this premises has an old and quite complicated licence, therefore it might confuse rather than clarify things for you. So any questions when you’ve had a look please email or give me a call.

We are trying to work with the current premises licence holder to make to changes to their licence to simplify things.

With regard to recorded music this was de-regulated in the Licensing Act 2003 between the hours of 08.00 and 23.00. The licence allows for an extension from 23.00 to 02.00 everyday, but that should be indoors. So they shouldn’t have a speaker outside after 23.00 at the latest. There are no specific conditions on the licence relating to the doors needing to be shut at a certain time, however there are conditions on the licence about the Prevention of Public Nuisance that relate to noise and respecting neighbours. In addition all premises licence holders are expected to operate with regard to the 4 licensing objectives, which are.

 

o The Prevention of Crime and Disorder

o Public Safety

o Prevention of Public Nuisance

o    Protection of Children from Harm

As I think I said before it is my intention re-visit this premises in the next week at which point I will raise your complaint with the Premises Licence Holder (none of your details will be given). Hopefully this will help to address the problem.

Thanks so much for your email.

What we'd really like, also conversation with friends on the street, is to be directed to what's actually allowed within a bar like thats licence in regard to times for music and doors wide open.

Or even these days portable speaker being positioned 15m from our front door. Is that even allowed?

Please just let us know what the rules are?

I'm sure you are both incredibly busy and spend yours days managing upset residents who can't be always pleasant to deal with, so I appreciate your guys time and the job you do.
